Terms

  1. General provisions.
  1. These Rules and Regulations determine the conditions of use of the Internet service for the Bitspiration Booster programme available at the following address: http://booster.bitspiration.com
  2. Use of the Service as well as other services offered via said system is equal to granting consent for the provisions of these Rules and Regulations (‘Rules and Regulations’), as well as the Privacy Policy.

  3. The administrator of the Service providing services by electronic means is Booster sp. z o.o. with registered office in Kraków at ul. Łabędzia 9, 30-651 Kraków, entered into the Register of Entrepreneurs maintained at the District Court for Kraków Śródmieście in Kraków, National Court Register Section with the KRS number: 0000635863, NIP number: 6793133399, with the share capital in the amount of PLN 5,000.00.

  4. The hereby Rules and Regulations represent terms and conditions provided in article 8 of Polish Act of 18 July 2002 on Providing Services by Electronic Means.

  5. Any and all rights to the name of the Service, its graphic and functional concept, rights to any text and graphic elements used within the Service, except for elements procured from third parties (including but not limited to wordmarks of partners, media partners, sponsors, partner conferences etc.) shall belong to BOOSTER and may be used solely on the basis of the consent (licence) granted by BOOSTER.

  6. Legal basis for these Rules and Regulations shall, including but not limited to, constitute the following acts of Polish law:do

    1. Act of 29 August 1997 on Protection of Personal Data;

    2. Act of 18 July 2002 on Providing Services by Electronic Means;

    3. Act of 23 April 1964 - Civil Code;

    4. Act of 30 May 2014 on Consumer Rights.

  7. In the matters related to the use of the Service, the User may contact BOOSTER via electronic mail at the following address: paula@bitspiration.com or, alternatively, via telephone at the following number: (+48) 605 177 682.

 

  1. Certain Defined Terms

For the purpose of these Rules and Regulations the following terms shall have the following meaning:

  1. Service - the Internet web page at http://booster.bitspiration.com which contains the information related to the Programme;

  2. BOOSTER - Booster sp. z o.o. with registered office in Kraków at ul. Łabędzia 9, 30-651 Kraków, entered into the Register of Entrepreneurs maintained at the District Court for Kraków Śródmieście in Kraków, National Court Register Section with the KRS number: 0000635863, NIP number: 6793133399, with the share capital in the amount of PLN 5,000.00;

  3. User – natural or legal person who uses the Service;

  4. Programme - Bitspiration Booster programme, organised by BOOSTER on the basis of separate terms and conditions, available at the Service.

 

  1. Terms of Use of the Service.

  1. Using the Service and all of its functions requires access to the Internet and application of a standard Internet browser.

  2. In order to guarantee safety for data transfers via the Service, BOOSTER shall apply any and all technical and organizational measures adequate for the level of threat related to the use of Service.

  3. The User shall be obliged to observe the prohibition of overuse of the Service, including but not limited to:

    1. providing content that causes interruptions in the functioning of the Service or an overload thereof, alternatively, of the systems used by entities that participate directly or indirectly in the provision of services via electronic means;

    2. providing content that may infringe personal rights of third parties, copyright, intellectual property rights, entrepreneurial secrets or those that may in any way infringe the legal governance in force or public decency;

    3. providing content that contains computer viruses and other malware like: worms, trojan horses, keyloggers or other;

    4. providing content that causes sending unsolicited by the recipients commercial information (SPAM) or other content forbidden by law as well as providing other types of unlawful content.

  4. BOOSTER hereby informs, that using the Service and its functionalities does not generate any particular risk, beyond the normal risk connected with using the Internet. Nevertheless, it is highly recommended to use the standard antivirus software, firewall etc.

 

  1. Services rendered by the Service

  1. The User, by choosing the appropriate User registration form, may register to the Programme via Service.

  2. Registering to the Programme is free of charge and voluntary.

  3. In the registration form the User shall provide the following information:

    1. company name;

    2. one-line company pitch (3-5 words);

    3. website/URL;

    4. stage;

    5. pitch deck;

    6. location;

    7. name and surname;

    8. e-mail address;

    9. additional information (if any).

  4. Before the abovementioned registration form is submitted, the User shall be obliged to read and acknowledge the contents of the Rules and Regulations, Privacy Policy and Programme’s terms and conditions. By submitting a filled out form and sending it to BOOSTER, the User expresses their will to enter into the Programme.

  5. Entering into the Programme and any and all further actions are regulated in Programme’s rules and regulations, available in the Service.

  6. The User, who is a consumer, shall be entitled to rescind the agreement entered into with BOOSTER concerning services rendered by electronic means without any additional costs or providing reasons therefore at any time, including within 14 days of entering into the Agreement. Statement on rescinding might be made in any form, including an e-mail. The User may use the Statement of Rescission template attached thereto. The provisions concerning rescission from the Programme is included in Programme’s terms and conditions.

 

  1. Personal Data.

  1. BOOSTER shall process personal data of the Users within the scope and in accordance with the conditions outlined in detail hereinbelow.

  2. The administrator of personal data will be BOOSTER sp. z o.o. with registered office in Kraków at ul. Łabędzia 9, 30-651 Kraków, entered into the Register of Entrepreneurs maintained at the District Court for Kraków Śródmieście in Kraków, National Court Register with the KRS number: 0000635863, NIP number: 6793133399, with the initial capital in the amount of PLN 5,000.00.

  3. BOOSTER shall process personal data of the Users, as submitted in the registration form, with the purpose of entering into the Programme. Article 23 paragraph 1 section 3 of the Act of 29 August 1997 on Protection of Personal Data provides legal grounds for processing personal data.

  4. If a legal person was registered, BOOSTER shall be entitled to process only personal data of the person completing the registration procedure with the above purpose, and who may grant such consent by marking the relevant field in the registration form.

  5. BOOSTER shall be entitled to process personal data of the Users for marketing purposes related to the presentation of BOOSTER`s business activity and the company`s offer, as well as its partners, if said persons granted such consent by marking relevant fields in the User registration form.

  6. User`s expressing his consent for personal data processing in the above mentioned scope is fully voluntary and shall not constitute a condition sine qua non for participation in the Programme.

  7. The Users shall be entitled to inspect their own personal data and to amend them.

  8. Except for cases defined hereinabove, BOOSTER shall disclose personal data in cases when such disclosure is strictly required by legal provisions in force.

 

  1. Complaints

  1. The User may send any and all complaints to the e-mail address at paula@proidea.com or in writing to the registered address of BOOSTER.

  2. The complaint shall consist of the User’s name, address, the reason of the complaint and the User’s request.

  3. Complaints related to the course of the Programme may be filed within 30 days of the date the Programme finished. The date of receiving the complaint by BOOSTER shall be deemed the date of filing thereof.

  4. BOOSTER will process the complaint within 14 days from the date of receiving the complaint. The answer shall be sent via e-mail or via traditional mail, depending on the way the complaint was filled.

 

  1. Final Provisions.

  1. Unless these Rules and Regulations stipulate otherwise, communications between BOOSTER and the User who sent registration form, shall be executed by electronic means, for the User by means of the email address identified in the Account settings, and for BOOSTER by means of the following email address: paula@bitspiration.com or another address in the BOOSTER.org.pl domain.

  2. If some of the provisions of these Rules and Regulations are deemed invalid or ineffective by the provisions of the law, the validity or effectiveness of the remaining provisions of these Rules and Regulations shall not be affected. In place of the invalid provision a rule shall be applied which represents the purpose of voided provision and the entire Rules and Regulations the closest.

  3. Privacy Policy constitutes an integral part of these Rules and Regulations.

  4. BOOSTER states that it does not use any code of good practice. The customer may use the alternative dispute resolution measures, including the ORD platform: http://ec.europa.eu/consumers/odr/.

  5. Current version of Rules and Regulations is published on the Service webpage and delivered, free of charge, to the User at his demand to the email address identified by the User.
